Legal, privacy, copyright, refund, cookie, and medical-disclaimer pages are part of the site architecture: they define how the educational library can be used, shared, and interpreted.

Terms of Service

Welcome to OrthoVellum. These Terms of Service (the "Terms") cover your use of the OrthoVellum website, any apps we offer, and any related services (together, the "Service"). Please read them carefully before you use the Service.

When you use the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you have read and accepted these Terms and our Privacy Policy. If you use the Service for an organisation, you confirm you have the authority to accept these Terms on its behalf.

2. Description of Service

OrthoVellum is an educational platform that helps medical professionals and trainees study and reference orthopaedic surgery. The Service includes things like:

  • Educational content on orthopaedic surgery topics
  • Evidence-informed article and topic pages
  • Editorial policy, methodology, disclosure, and correction information
  • Educational images, diagrams, and multimedia content where available

3. User Accounts

3.1 Account Creation

Some features need an account. When you sign up, you agree to:

  • Give accurate, current, and complete information
  • Keep your account details up to date
  • Keep your password private and secure
  • Tell us straight away if someone accesses your account without permission
  • Take responsibility for everything that happens under your account

3.2 Account Eligibility

You must be at least 18, or the age of majority where you live, to create an account. The Service is meant for medical professionals and trainees.

4. Acceptable Use

You agree not to:

  • Use the Service for anything unlawful or against any law that applies to you
  • Share, distribute, or reproduce content from the Service without permission
  • Try to access any part of the Service you are not allowed to
  • Use bots, scrapers, or other automated tools to access the Service
  • Interfere with or disrupt the Service or its servers
  • Pretend to be another person or organisation
  • Share your login details with anyone else
  • Use the content for commercial purposes without our written permission
  • Get around any access limits or content-protection measures

5. Intellectual Property

5.1 Our Content

The Service and its original content, features, and functionality belong to OrthoVellum and are protected by copyright, trademark, and other intellectual property laws. This includes:

  • All written educational content and topic pages
  • Images, diagrams, and multimedia content
  • Software code and algorithms
  • The OrthoVellum name, logo, and branding

5.2 Your Content

You keep ownership of anything you submit to the Service, such as study notes or feedback. By submitting it, you give OrthoVellum a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content within the Service.

5.3 Account and Content Protection

Your account and any subscription are for your personal use only. To stop account sharing, we may limit how many sessions run at once, watermark paid content (including questions, cases, and model answers) to the account viewing it, and use rate limits and bot detection.

You must not scrape, bulk-download, copy, resell, or redistribute any paid content, and you must not share your account with anyone else. Doing so may lead to immediate closure of your account and legal action.

6. Medical Disclaimer

The Service is for education only. Nothing on OrthoVellum is a substitute for professional medical advice, diagnosis, or treatment. Always ask your doctor or another qualified health professional about any medical condition.

The Service is meant to support your medical training, not replace it. Base clinical decisions on direct patient assessment and current clinical guidelines, not on information from this Service alone. See our full Medical Disclaimer for more.

7. Subscription and Payments

7.1 Free and Paid Services

OrthoVellum has free content (the topic library, exam outlines, and community) and paid subscriptions (Exam Access, Exam + AI Mentor, All Access, and an AI Mentor add-on) that unlock the exam-practice tools. A one-time, no-card, 24-hour preview gives you limited access to a few paid items so you can try the Service before you subscribe. Prices, features, and renewal terms are shown before you buy on our pricing page.

7.2 Billing

Paid plans are charged straight away through our payment processor, Stripe, at the price shown at checkout, in Australian dollars (AUD). They renew automatically each billing period until you cancel. You can cancel any time in billing management, and your access continues until the end of the period you have paid for. Your bank may add currency conversion or foreign-transaction fees.

7.3 Refunds

Refund and cancellation terms are set out in our Refund Policy and shown before you buy.

8. Termination

We may suspend or close your account and access to the Service at any time, without notice, for any reason, including a breach of these Terms. You can close your account whenever you like in your account settings.

When your account ends, your right to use the Service ends too. Any parts of these Terms that are meant to keep applying after that will continue to apply.

9. Limitation of Liability

To the maximum extent the law allows, OrthoVellum and its operator, contributors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive losses, including:

  • Loss of profits, data, or use
  • Errors or gaps in the content
  • Service interruptions or downtime
  • Anyone accessing your account without permission
  • Learning, professional, or clinical outcomes

Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months before the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available", with no warranties of any kind, whether stated or implied. We do not promise that:

  • The Service will be uninterrupted or error-free
  • All content is accurate, complete, or up to date
  • The Service will meet your specific needs
  • Using the Service will guarantee any learning, professional, or clinical outcome

11. Indemnification

You agree to cover OrthoVellum and its operator, contributors, and agents for any claims, damages, losses, or costs that arise from your use of the Service or your breach of these Terms.

12. Changes to Terms

We may change these Terms at any time. If we make a significant change, we will post the updated Terms on the Service and update the "Last updated" date. If you keep using the Service after that, you accept the new Terms.

13. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict-of-law rules. Any dispute about these Terms or the Service will be handled in the courts of Western Australia, Australia.

14. Severability

If any part of these Terms cannot be enforced, the rest still applies in full.
