Welcome to OrthoVellum. These Terms of Service ("Terms") govern your access to and use of the OrthoVellum website, mobile applications, and services (collectively, the "Service"). Please read these Terms carefully before using the Service.

OrthoVellum is an educational platform designed to assist medical professionals and trainees in preparing for orthopaedic surgery fellowship examinations. The Service includes, but is not limited to:

  • Multiple choice question (MCQ) practice
  • Image-based short answer (ISAWE) scenarios
  • Flashcard and spaced repetition systems
  • Progress tracking and analytics
  • Community forums and study groups
  • Mock examination simulations

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration

  • MCQ questions and explanations
  • ISAWE scenarios and marking guides
  • Images, diagrams, and multimedia content
  • Software code and algorithms
  • The OrthoVellum name, logo, and branding

5.2 Your Content

You retain ownership of any content you submit to the Service (e.g., forum posts, study notes). By submitting content, you grant OrthoVellum a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the Service.

The Service is for educational purposes only. Content provided on OrthoVellum is not intended to be a substitute for professional medical advice, diagnosis, or treatment. 7. Subscription and Payments

7.1 Free and Paid Services

Some features of the Service are available for free, while others require a paid subscription. Subscription terms, pricing, and features will be clearly displayed before purchase.

7.2 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). Your subscription will automatically renew unless you cancel before the renewal date.

7.3 Refunds

Refunds are handled according to our Refund Policy. Generally, we offer a 14-day money-back guarantee for new subscriptions.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. You may terminate your account at any time through your account settings.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

9. Limitation of Liability

To the maximum extent permitted by law, OrthoVellum and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Errors or omissions in content
  • Service interruptions or downtime

  • Exam results or professional outcomes

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • All content is accurate, complete, or current
  • The Service will meet your specific requirements
  • Use of the Service will guarantee exam success

11. Indemnification

You agree to indemnify and hold harmless OrthoVellum and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of New South Wales, Australia.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
